Child Custody

Experienced Phoenix Child Custody Attorney

Custody disputes place a tremendous emotional burden on parents as well as their children. As a parent of three children and a person who has experienced a divorce herself, Paula Burnstein understands how difficult it can be to go through a divorce with children. At her Phoenix, Arizona, office, Paula Burnstein practices solely in the area of family law. She can handle any child custody or visitation matter including initial custody determinations, modifications of custody orders, and parenting time disputes.

Custody and Parenting Time Disputes

Paula Burnstein has experience in all major areas of child custody and parenting time matters, including:

  • Custody Determinations- Early in the process of a divorce, a Court may make a temporary custody order. The Court may award the majority of parenting time to one parent or divide parenting time on a fairly even basis. These initial temporary orders are not binding on the Court's final determination of custody, but they can have a significant effect on the Court's final determination of custody. At the conclusion of a trial, the Court will issue a final dissolution order which will determine the custody of the children. Anyone going through a divorce should retain an experienced divorce attorney to protect their rights as a parent.

  • Modifications of Custody Orders- It is difficult to change custody once a Court has issued a final divorce order. However, in certain situations, a parent can make a motion for modification of a custody order. Some of the causes for a change of custody include physical abuse of a child, sexual abuse, and persistent drug use by a parent. Parents concerned with the welfare of their children should  contact an experienced divorce attorney for help.

  • Parenting Time Disputes- During and after a divorce, parents often have parenting time disputes. Some of the most common areas of contention include holidays, birthdays, and family vacations. An experienced divorce lawyer can provide the legal help needed to resolve parenting time disputes.
